1. Agreement to Terms
Welcome to Bariportal Enterprise. These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Bariportal Enterprise ("we," "us," or "our"), concerning your access to and use of the Bariportal website and mobile applications, as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.
By creating an account, browsing property listings, or utilizing our rental booking engine and digital tenancy contract services, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the platform and must discontinue use immediately.
2. Eligibility and Account Management
The platform is intended for users who are at least 18 years of age. All registration data you submit must be complete, truthful, and accurate. You are solely responsible for maintaining the confidentiality of your account credentials and password, and you agree to accept responsibility for all activities that occur under your account.
Bariportal reserves the right to suspend or terminate accounts that provide false details, upload fraudulent listings, or engage in behaviors that violate local municipality guidelines, the Digital Security Act, or the general standards of this platform.
3. Landlord Property Listings
Property owners or authorized property managers ("Landlords") who list apartments, family homes, rooms, or commercial spaces represent and warrant that:
- They hold legal title, ownership deeds (dalil), or explicit written power of attorney to lease the property.
- All listed parameters (rent amount, security deposit requirements, dimensions, utility statuses, location coordinates, holding tax slips) are accurate and kept up to date.
- They will not solicit off-platform cash deposits or side-contracts designed to bypass platform fees, as this directly violates our payment security rules and voids escrow protections.
- They consent to physical inspection audits of the property by Bariportal validation agents.
4. Tenant Bookings and Escrow System
To reserve a property, tenants must submit a holding deposit through our integrated payment systems. This deposit is held securely in the Bariportal escrow vault and is governed by the following rules:
- The deposit is not disbursed to the Landlord until a legally compliant tenancy agreement is e-signed by both parties and key handover is confirmed.
- Bariportal collects a platform service fee, which is clearly displayed prior to executing transaction payments.
- Bypassing the billing system to arrange private rentals is a material breach of these terms and will result in permanent platform suspension.
5. Limitation of Liability
Bariportal is a software facilitator and marketplace connecting tenants and landlords. We do not own, build, or directly manage any properties listed. Consequently, Bariportal is not liable for disputes arising from lease breaches, physical property damage, utility failures, or misrepresentations by either party, to the maximum extent permitted by the laws of Bangladesh.
6. Jurisdiction and Governing Law
These Terms shall be governed by and defined in accordance with the Contract Act, 1872, and the Rent Control Act, 1991 of Bangladesh. Any legal action or dispute arising under these terms shall be referred to the jurisdiction of competent courts in Dhaka, Bangladesh.
